Conditions of bicycle and equipment rental and guided bicycle tours

1. CONTRACTING PARTIES

1.1) These Terms and Conditions apply to bicycle and equipment rentals and, where applicable, guided bicycle tours provided by FOREVER CYCLING S.L., trading as bike2malaga.

The person entering into the Rental Agreement must be at least 18 years old and is referred to in these Terms and Conditions as the “Renter”.

The Renter may rent bicycles and other equipment for themselves and for other riders, including minors. Where a rider is under 18, the Renter confirms that the minor has the permission of their parent or legal guardian and assumes responsibility for ensuring appropriate adult supervision. The Renter remains responsible for all rented items and for ensuring that all riders comply with the Rental Agreement and these Terms and Conditions.

1.2) bike2malaga will provide the bicycles, components and accessories specified in the booking or Rental Agreement, collectively referred to as the “rented items”, in usable condition and for the agreed rental period.

The Renter agrees to pay the applicable rental price and any other amounts due under the Rental Agreement.

1.3) Unless otherwise agreed, a one-day rental begins at 09:00 and ends at the closing time of the applicable rental location on the same day. Closing time may vary depending on the season and will be confirmed at the time of booking. Different handover and return times, multi-day rentals and next-morning returns may be agreed and recorded in the booking or Rental Agreement.

1.4) Unless delivery or collection has been agreed, the rented items must be collected from and returned to:

1.5) Where delivery or collection is agreed, the Renter must provide an accurate address, meeting point and working mobile telephone number. Delivery and collection will take place at the time and location recorded in the booking or Rental Agreement.

Any requested change must be communicated to and confirmed by bike2malaga.

1.6) The Renter is responsible for reasonable additional transport, waiting or rental costs caused by an unnotified delay, absence from the agreed meeting point or late return.

1.7) Exceptional circumstances outside the reasonable control of bike2malaga may cause a delay or require a change to an agreed delivery or collection. The Renter will be informed as soon as reasonably possible.

1.8) The Renter must inspect the rented items at handover and report any visible damage or defect before use.

A cleaning charge of €20 may apply if a bicycle is returned exceptionally dirty.

2. RESERVATIONS, PRICES, PAYMENT AND PRE-AUTHORIZATION

2.1) Advance booking is recommended and may be required to guarantee availability. Same-day rentals and walk-in rentals without a prior reservation may be available, subject to bicycle and equipment availability. Customers may visit the bike2malaga shop, call or email to check availability.

2.2) Unless different conditions are stated during the booking process, a prepayment of €20 per bicycle is required to confirm the reservation.

2.3) The outstanding rental balance must be paid no later than the handover of the rented items and signing of the Rental Agreement. Accepted payment methods are those displayed during booking or accepted at the applicable bike2malaga location.

2.4) Where a prepayment or any other payment is made by bank transfer, the Renter is responsible for any transfer fees charged by their bank or by intermediary banks. Payment is considered complete only when the full amount due has been received by bike2malaga.

2.5) A card pre-authorization of €300 per bicycle is required as security. A pre-authorization is not a payment or a limit on the Renter’s liability.

2.6) The Renter authorizes bike2malaga to charge the card used for the rental for amounts due for loss, theft or damage to the rented items and for other amounts due under the Rental Agreement. Such charges may be processed at a later date without further authorization from the Renter. The pre-authorization may be applied as partial payment. If the amount due exceeds the pre-authorization, the Renter remains liable for the outstanding balance.

2.7) All consumer prices stated on the website, in the booking and in the Rental Agreement include applicable taxes unless expressly indicated otherwise.

3. CANCELLATION, NON-ATTENDANCE AND EARLY RETURN

3.1) If a reservation is cancelled at least 14 calendar days before the scheduled rental start date, the amount paid will be refunded, less any non-refundable bank or payment-processing fees actually incurred.

3.2) If the Renter cancels the reservation less than 14 days before the scheduled rental start date, the €20-per-bicycle prepayment is non-refundable.

3.3) If the Renter does not collect the rented items on the agreed rental start date and has not notified bike2malaga of the delay, bike2malaga may treat the booking as a no-show, cancel the reservation and make the rented items available to other customers. The €20-per-bicycle prepayment is non-refundable, and bike2malaga is not required to keep the rented items available for the remainder of the original rental period.

3.4) No refund is due for an early return of rented items or for unused rental time, except where required by applicable law or expressly agreed by bike2malaga.
Personal circumstances, illness, travel disruption or unsuitable weather do not automatically entitle the Renter to a refund. Any exception will be considered in accordance with applicable law and the circumstances of the booking.

3.5) Special cancellation conditions may apply to bookings connected with major cycling events, races, gran fondos, marathons or similar events. Any such conditions must be communicated to the Renter before the booking is confirmed.

4. USE, CARE AND SECURITY OF RENTED ITEMS

4.1) The Renter is responsible for all rented items from handover until they are returned to and accepted by bike2malaga.

The Renter must ensure that all riders using the rented items use them with due care, comply with applicable traffic regulations and follow any safety or operating instructions provided by bike2malaga.

4.2) A rented bicycle must not be:
◦ used under the influence of alcohol or drugs;
◦ used to carry a passenger unless it is specifically designed and supplied for that purpose;
◦ modified or altered without prior authorization from bike2malaga.

All rented equipment and accessories are provided for their intended human use only. Dogs and other animals must not be transported or accommodated in any rented bicycle, trailer, bag, basket, seat or other accessory.

4.3) Additional equipment may be fitted only after prior communication with and approval by bike2malaga. The Renter assumes responsibility for any risk, loss or damage arising from the fitting or use of such equipment.

4.4) Whenever not in use, bicycles must be stored indoors or in a secure locked storage area. They must not be left unattended in the street, even when locked. The Renter remains responsible for the rented items throughout the rental period, including while stored or locked.

4.5) The rented items must be returned on the agreed date, at the agreed time and place, to bike2malaga or its authorized representative.

5. REPAIRS, BREAKDOWNS AND ASSISTANCE

5.1) The Renter is responsible for punctures and other minor roadside repairs occurring during the rental period. Any such repair must be carried out correctly and with reasonable care to avoid causing further damage.

5.2) For any repair other than a minor roadside repair, the Renter must either bring the rented item to bike2malaga for inspection and repair or obtain prior authorization from bike2malaga before having the repair carried out elsewhere. Reasonable repair and service charges may apply depending on the cause and circumstances of the issue. Costs incurred at another workshop without prior authorization will not be reimbursed.

5.3) Any damage, malfunction or accident involving the rented items must be reported no later than when the rented items are returned. Loss, theft or damage affecting the safe operation of a bicycle must be reported without undue delay.

5.4) If the Renter requests transport, roadside assistance, mechanical support or a replacement bicycle from bike2malaga, reasonable transport and service charges may apply.

5.5) bike2malaga will make reasonable efforts to provide technical assistance, but assistance is subject to opening hours, staff availability, the Renter’s location and practical accessibility. Immediate roadside assistance or arrival at a specific time cannot be guaranteed. Any replacement bicycle is subject to availability. Assistance will be provided as soon as reasonably possible.

6. LOSS, THEFT AND DAMAGE

6.1) The Renter is responsible for loss, theft and damage to the rented items occurring between handover and return.

6.2) Loss or theft of any rented item must be reported to bike2malaga without undue delay. Theft must also be reported to the police, and the Renter must provide bike2malaga with a copy of the police report.

6.3) Repairable damage to any rented item will be charged at the reasonable cost of repair, including the required parts and labour.

If a bicycle is covered by a category or model listed below and is lost, stolen or damaged beyond economical repair, the Renter will be charged the applicable minimum replacement charge. If the reasonable current replacement cost is higher than the listed minimum charge, the Renter will be charged the current replacement cost.

6.4) If a bicycle, component or accessory is not covered by any category or model listed below and is lost, stolen or damaged beyond economical repair, the Renter will be charged its current market replacement cost. Where a replacement component or accessory must be fitted, reasonable labour costs will be charged in addition.

6.5) The following minimum replacement charges apply. All stated amounts include applicable VAT:

Where both a general bicycle category and a specific bicycle model apply, the model-specific minimum replacement charge will apply.

6.6) bike2malaga recommends that the Renter obtain suitable travel, personal accident and rental-equipment insurance. Where an insurance claim is made following loss, theft or damage, bike2malaga will provide reasonable supporting documentation available to it.

7. E-BIKES

7.1) Only the charger supplied with the bicycle may be used. Batteries must not be charged in direct sunlight or in a location exposed to rain or water.

7.2) Any stated battery range is an estimate and is not guaranteed. Actual range depends on factors including assistance level, route, elevation, weather, rider weight, riding style and any additional load carried, including luggage, cargo and fitted accessories.

7.3) The battery, charger, keys and any other supplied e-bike equipment must be returned with the bicycle. Missing or damaged items will be charged in accordance with Section 6.

8. GUIDED BICYCLE TOURS

8.1) Participants must follow the guide’s reasonable safety instructions and comply with applicable traffic regulations.

8.2) Each participant is responsible for ensuring that they are physically capable of taking part in the selected tour and for informing bike2malaga before the tour of any relevant medical condition or limitation that may affect safe participation.

8.3) A participant under 18 may take part in a guided tour only with the permission of their parent or legal guardian and must be accompanied by a responsible adult. The adult accompanying the minor confirms that the required permission has been obtained and is responsible for supervising the minor throughout the tour and for ensuring that the minor follows the guide’s instructions and complies with applicable traffic regulations.

8.4) Participants acknowledge that cycling involves inherent risks, including falls, collisions, traffic, changing road or trail conditions, weather and terrain.

8.5) bike2malaga may modify, shorten, postpone or cancel a tour where reasonably necessary because of weather, safety concerns, road conditions, instructions from public authorities or other circumstances outside its reasonable control. The available alternatives and any applicable refund will be determined in accordance with the circumstances and applicable law.

8.6) bike2malaga reserves the right to refuse or terminate a person’s participation in a guided tour if the person arrives too late to join the tour without delaying or disrupting it, is clearly unable to demonstrate the cycling skills required to participate safely, or bike2malaga reasonably believes that the person is under the influence of alcohol or drugs, refuses to follow the guide’s instructions or applicable traffic regulations, behaves dangerously, or otherwise creates a material risk to themselves or others. In such circumstances, the applicable prepayment will not be refunded.

9. LIABILITY, FINES AND INSURANCE

9.1) The Renter is responsible for fines, penalties, injury or damage resulting from unlawful or improper use of the rented items, failure to comply with traffic regulations or disregard of instructions provided by bike2malaga.

9.2) The Renter is responsible for arranging any personal accident, travel or rental-equipment insurance considered necessary.

9.3) FOREVER CYCLING S.L. maintains commercial third-party liability insurance for its bicycle-rental activities. The liability of FOREVER CYCLING S.L. for its own acts or omissions is governed by applicable law.

9.4) Nothing in these Terms and Conditions excludes or restricts the Renter’s mandatory consumer rights or any liability that cannot legally be excluded or restricted.

10. PERSONAL DATA

10.1) FOREVER CYCLING S.L. is the data controller. Personal data is processed for the administration and performance of bookings and Rental Agreements, payment management, customer communication, compliance with legal obligations and the establishment, exercise or defence of legal claims.

10.2) Personal data will be retained for the periods required by applicable law and for as long as reasonably necessary in connection with an outstanding payment, incident, insurance matter or legal claim.

The processing of personal data is governed by the General Data Protection Regulation (EU) 2016/679, Spanish Organic Law 3/2018 and other applicable data-protection legislation.

11. APPLICABLE LAW AND JURISDICTION

11.1) These Terms and Conditions and the Rental Agreement are governed by Spanish law, without prejudice to the Renter’s mandatory consumer rights.

11.2) Subject to mandatory consumer-jurisdiction rules, the courts of Málaga, Spain, shall have jurisdiction over disputes arising from or relating to the Rental Agreement or these Terms and Conditions.
